Business purposes

We may share your personal information by disclosing it to a third party for a business purpose (“Business Purpose Disclosure”). In the preceding 12 months, we have not disclosed personal information in a Business Purpose Disclosure.

Business Purpose Disclosures may include, but are not limited to, the following circumstances:

As outlined in this Privacy Policy, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "When and With Whom We Share Your Personal Information." You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. In addition, given the nature of sharing on the Services, some of the content and information related to your account, such as Contributions you make to chats, message boards, online forums, or direct messaging prior to deletion will remain accessible to the other users and stored on our servers.

6. HOW WE KEEP YOUR INFORMATION SAFE.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology is guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;

  • enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • comply with a legal obligation; or
  • make other internal and lawful uses of that information that are compatible with the context in which you provided it.

In addition, given the nature of sharing on the Services, some of the content and information related to your account, such as Contributions you make to chats, message boards, online forums, or direct messaging prior to deletion will remain accessible to the other users and stored on our servers. • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California’s privacy law).

How to exercise your rights

You can submit a request to exercise your rights to access, correct, or delete your personal information by sending an email to hello@herogeneration.co. Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

  • Verification of Your Identity. We will need your contact information, and may ask for your name, address, phone number, or email, to verify your identity for access, correction, or deletion requests. Our verification process may also include asking you to log into your account and complete a one-time passcode validation, asking you to answer a few questions about yourself to help us verify your identity, and using a third-party identification service to assist us. We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

9. CONTROLS FOR DO-NOT-TRACK FEATURES.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

10. CHANGES TO OUR PRIVACY POLICY.

We reserve the right to amend this Privacy Policy at our discretion and at any time. When we make changes to this Privacy Policy, we will post a notice to our website that we have done so. The updated version will be indicated by an updated "Last Updated" date at the top of this Privacy Policy. Your continued use of our website or the Services following the posting of changes constitutes your acceptance of such changes.
